Terms and Conditions of Use for HR Leave Hub

Agreement between the User and HR Leave Hub (HR Team Ltd)

The following Terms and Conditions apply to all users of HR Leave Hub software Platform, a product of HR Team Ltd, based at 10A Ebrington Square, Derry-Londonderry, Northern Ireland, BT47 6FA.

The following terms have the following meanings:

Owner: HR Team Ltd
Platform: HR Leave Hub

“Terms of use”: The agreement for services entered into between the Customer and HR Team Ltd. Trading As (T/A) HR Leave Hub as set out in these Terms and Conditions of Use or any individual contract in place.

“Contract”: These terms and conditions, along with the registration email which the customer receives after registering on the platform, form the Contract between the customer (account holder) and HR Leave Hub (HR Team Ltd). Third-party terms and conditions are not valid and shall not apply unless HR Leave Hub provides prior written consent to any deviating terms and conditions.

“Fee”: The agreed fee payment to be paid by the Customer to HR Team Ltd. Trading As (T/A) HR Leave Hub for the Service provided.

“Period”: The period for which HR Team Ltd. Trading As (T/A) HR Leave Hub provides the Service to the Customer as specified in these Terms and Conditions of Use, or any individual contract in place.

“Service”: The service to be provided to the Customer by HR Team Ltd. Trading As (T/A) HR Leave Hub is to provide access to the HR Leave Hub software system over the agreed period in the Contract.

“Platform”: Refers to the HR Leave Hub SaaS solution, accessible at app.hrleavehub.com.

“Customer”: The Customer is the organisation bank account holder which pays the Fee.

“User”: Any individual or entity granted access to the Platform under these Terms.

“Admin User”: Any individual granted Admin access to the Customer organisation set up on leave hub, including the first User who completes the initial registration.

“Owner”: HR Team Ltd, a Northern Ireland-registered company. HR Team Ltd. Trading As (T/A) HR Leave Hub (NI Company Number NI616121 ).

1. Acceptance of Terms

By accessing or using the HR Leave Hub ("the Platform"), you agree to comply with these Terms and Conditions. If you do not accept these terms, you must not use the Platform.

2. Contract

The User’s successful completion of the registration process on HR Leave Hub will create a contractual relationship between the Customer and the Owner.

A Customer account must be set up to use the Platform, requiring the User to create a customer account ("Account") to use the software. To set up the account, the required data must be specified, and a password set up. By clicking the "Subscribe” button, the Customer submits a binding offer to conclude a free licensing agreement, a 14-day free trial, to the Platform. HR Leave Hub can accept the offer by finalising set up and granting the Customer access to an account or by sending a message to the specified email address with the access data for account set up.

No contract exists between consumers and the Platform Owner. The Platform Owner does not provide services to consumers, they are solely for the commercial or independent professional activities of the Customer. As the Customer is not a consumer, they shall not have any legal right of revocation.

3. Services Provided

The Platform offers comprehensive employee leave management tools, including:

Automated leave calculations for part-time and full-time employees.
Real-time leave tracking for entitlements, requests, and balances.
Reporting tools for compliance with employment and working time law in Northern Ireland, Great Britain and Ireland.

4. Registration, Trial Period, and Account Security

Users are required to provide accurate and complete information when registering. Misrepresentation or fraudulent behaviour may result in suspension or termination of services.

Every Customer shall only be entitled to register once for a free trial period. HR Leave Hub is authorised to access data such as device ID, payment method or the email address previously used for an existing or a recently existing registration. If you wish to use the Platform after the trial period expiration, there is NO need for further action. You will continue to receive the Platform’s services for a monthly fee and can terminate the contractual relationship at the expiry of each extension period of one month. The monthly fee and free trial period end date can be viewed in the account settings. To terminate your account during or after the trial period, go to ‘My Account’ settings and click the ‘Delete Account’. If this is done during the trial period, no Fee will be payable by the Customer for the upcoming monthly period or thereafter at the end of the trial period.

If the account is to be used after the free trial period expires, you must enter valid payment information. By doing so, the Customer shall conclude a contract with the Owner against payment of a fee. The corresponding usage fee shall be debited at the beginning of each monthly term.

5. Payment Terms

Fees are charged on a subscription basis, with rates specified during sign-up.
Payments are non-refundable unless explicitly agreed otherwise.
Access to the Platform may be suspended for non-payment after reasonable notice.

6. Data Protection and Privacy

HR Team Ltd complies with the UK General Data Protection Regulation (UK GDPR) and Northern Ireland-specific data protection laws. Personal data collected through the Platform is processed as outlined in our Privacy Policy.

7. User Obligations

Users must:

Use the Platform in accordance with applicable laws.
Maintain the confidentiality of login credentials and immediately report unauthorised access or breaches.
The Customer shall provide information and facts on the Application regarding the Customer’s and employees’ information, as the Customer feels fit. The Customer shall be responsible for all such information placed by their employees and themselves on HR Leave Hub. The Customer shall indemnify the Owner at all times for any loss, expense, or damage incurred as a result of the Customer’s actions or omissions in connection with its use of the service, information placed by the Customer on the HR Leave Hub system, the use that it makes of user information provided through the Application or otherwise in connection with this agreement.
The Customer shall supervise and control the use of the Application by the Customer’s employees and Authorised Third Parties under the terms of this agreement from time to time as set out therein, including the Privacy Policy.
The Customer shall ensure that access to the Customer’s HR Leave Hub username and password is limited to authorised personnel and accepts that it is fully responsible for all and any access by any persons whatsoever.
The Customer shall notify HR Leave Hub promptly if the Customer becomes aware of any unauthorised access to use or copy of any part of the data held within the Application.
The Customer is solely responsible for the information placed on the Application themselves.

8. Payment Terms:

Monthly payments for our services are made under a rolling monthly contract.
Contract Termination by the Customer: If the customer chooses to terminate the contract before the end of the monthly term, the subscription will cease at the end of the current monthly period. To end your subscription, simply go to the ‘My Account’ section and click the ‘Delete Account’ button.
Breach of Contract: If the customer breaches any of the terms agreed upon in the monthly contract, they will be subject to charges for the remainder of the contract term.

9. Fees

Should the Customer wish to cancel the Service provided under the Contract at any time during the Period, no part of the Fee is refundable to the Customer.

10. Service Updates and Purpose of Service

HR Leave Hub shall be entitled to make changes to the presentation, layout, and functionality of the Application at any time.
HR Leave Hub shall be entitled to amend these Terms and Conditions of Service at any time. Changes to these shall be listed – with the most recent amendment date listed – on the app.hrleavehub.com and/or subdomains or the HR Leave Hub system at any time.
HR Leave Hub shall be entitled to use the Customer’s logo and any other necessary intellectual property of the Customer insofar as the use thereof is required by HR Leave Hub to provide the Service for the Customer.

11.Intellectual Property

All content, software, and intellectual property associated with the Platform are owned or licensed by HR Team Ltd. Users are granted a limited, non-exclusive license to use the Platform for its intended purpose.

12. Limitation of Liability

To the extent permitted by Northern Ireland law, HR Team Ltd. Trading As (T/A) HR Leave Hub is not liable for:

Indirect or consequential damages resulting from Platform use.
Loss of data caused by user negligence or third-party actions.
HR Team Ltd. Trading As (T/A) HR Leave Hub shall not be liable for any direct, indirect, incidental, special, or consequential damages resulting from the use or inability to use our services. In no event shall our liability exceed the total fees paid by the customer for the service during the previous one-month period.

13. Termination of Services

HR Team Ltd may terminate or suspend access to the Platform for:

Breach of these Terms.
Non-payment of subscription fees, with prior written notice.
Should the Customer wish to cancel the Service provided under the Contract at any time during the Period, no part of the Fee is refundable to the Customer.

14. Governing Law and Dispute Resolution

These Terms are governed by the laws of Northern Ireland. Disputes will be subject to the exclusive jurisdiction of the courts in Northern Ireland.

15. Indemnification: Customers agree to indemnify and hold harmless HR Team Ltd. Trading As (T/A) HR Leave Hub from any claims, losses, liabilities, expenses, or damages arising out of their use of our services or any breach of this Agreement.

16. Severability Clause: If any provision of this Agreement is found to be unenforceable or invalid, that provision shall be deemed severed from this Agreement, and the remainder of the Agreement shall remain in full force and effect.
